1. Agreement to Terms

By accessing or using any product within the AI Duo Pics suite ("Apps", "Services"), including our custom dog, cat, and cuddly toy pics ecosystem, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you may not use our Apps.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and AI Duo ("we", "us", "our"). Please read them carefully.

2. Eligibility

You must be at least 13 years old (or 16 in the European Union) to use these Apps. By using the Apps, you represent and warrant that:

• You are at least 13 years of age (16 in the EU)
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

If you are using the Apps on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

AI Duo Pics provides a suite of artificial intelligence-powered products for creating custom, personalized pictures of dogs, cats, and cuddly toys. Our Services include:

• AI-generated custom images of your dog, cat, or cuddly toy based on photos you upload
• Style transformations, themed scenes, and creative portrait generation
• Personalized merchandise previews and shareable digital content
• Any additional products or features we release within the AI Duo Pics ecosystem

All AI processing is performed on our own secure servers using licensed enterprise infrastructure. Your data is never shared with third parties for their own purposes.

Important: Our AI-generated images are provided for personal, creative, and entertainment purposes only. They are not professional photography, veterinary assessments, or breed certifications of any kind.

4. User Accounts

4.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. Acceptable Use Policy

You agree NOT to use the Apps to:

• Upload content that infringes on intellectual property rights of others
• Upload illegal, harmful, threatening, abusive, or offensive content
• Upload images depicting minors, violence, or sexually explicit material
• Upload images of animals in distress or used in connection with animal cruelty
• Attempt to reverse-engineer, decompile, or hack the Apps
• Use automated tools (bots, scrapers) to access the Services
• Interfere with or disrupt the Apps' functionality or servers
• Impersonate others or misrepresent your affiliation
• Transmit viruses, malware, or other harmful code
• Collect user data without consent
• Use the Services for any illegal or unauthorized purpose
• Attempt to circumvent usage limits or payment requirements

Violation of this Acceptable Use Policy may result in immediate account termination and legal action.

6. Intellectual Property Rights

6.1 Your Photos

You retain all ownership rights to the photos of dogs, cats, and cuddly toys you upload ("Your Content"). By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process and analyze your photos using our AI systems to generate custom images
• Store your content on our secure servers
• Display your content and generated images back to you within the Apps
• Use aggregated, anonymized data for service improvement

We do not:

• Claim ownership of your original photos
• Share your photos with third parties for their commercial use
• Use your photos to train AI models without your explicit consent
• Publicly display your photos without permission

6.2 AI-Generated Images

Custom images generated by our Services ("Generated Content") are provided to you for personal, non-commercial use unless you have purchased a commercial licence. You may:

• Download and share Generated Content for personal use
• Print Generated Content for personal enjoyment

Without a commercial licence, you may not:

• Sell or commercially exploit Generated Content
• Use Generated Content in paid advertising or marketing campaigns
• Sub-license or transfer Generated Content to third parties for commercial purposes

6.3 Our Property

The Apps, including their design, code, features, branding, and AI models, are owned by AI Duo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. AI Limitations and Disclaimers

IMPORTANT: Please read this section carefully.

Our AI-powered image generation is produced by machine learning models and has inherent limitations:

• Not 100% Accurate: AI-generated images may not perfectly replicate the appearance of your pet or toy
• No Guarantees: We do not guarantee likeness, style accuracy, or specific output results
• Entertainment Only: Generated images are for creative and personal enjoyment, not professional photography
• Not Breed Identification: Generated images are not veterinary assessments, breed certifications, or health indicators
• Variability: Results may vary significantly between generations even from the same input photos
• Bias: AI models may reflect biases present in training data, including under-representation of certain breeds or toy types

You should not rely on AI-generated images for any important decisions. Always consult qualified professionals (e.g. vets, breeders) for critical matters relating to your pet.

8. Payments and Subscriptions

8.1 Pricing

We may offer free and paid subscription tiers, as well as one-time credit packs, with different features and generation limits. Pricing is displayed in the Apps and may be subject to change with notice.

8.2 Billing

• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for recurring subscription fees
• Prices may change with 30 days' notice
• You are responsible for all applicable taxes

8.3 Refunds

Refunds are handled according to the policies of the app store (Apple App Store or Google Play Store) through which you purchased the subscription or credit pack. We generally do not offer refunds for partially used subscription periods or consumed generation credits, except as required by law.

8.4 Cancellation

You may cancel your subscription at any time through the App or your app store account settings. Cancellation takes effect at the end of the current billing period. Unused generation credits in credit packs expire as specified at the time of purchase.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Apps, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

Our Apps use the following categories of third-party services:

• AI infrastructure providers — we license dedicated, private enterprise API capacity for AI processing; your data is not shared with, retained by, or accessible to these providers beyond the time needed to process your request
• Cloud hosting providers for secure data storage
• Payment processors for subscription management
• Analytics services for app improvement

Your use of the Apps may be subject to these third parties' terms and policies. We are not responsible for third-party services or their practices.

11. Disclaimers and Limitation of Liability

11.1 "AS IS" Basis

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED IMAGES.

11.2 No Warranty

We do not warrant that:

• The Apps will be uninterrupted, secure, or error-free
• AI-generated images will accurately resemble your pet or toy
• Defects will be corrected
• The Apps are free from viruses or harmful components

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI DUO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Business interruption
• Loss of goodwill or reputation
• Dissatisfaction with generated image results
• Financial losses from relying on AI-generated content

Our total liability for any claims arising from your use of the Apps shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless AI Duo, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Apps
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Photos or content you upload to the Apps

13. Changes to Service

We reserve the right to modify, suspend, or discontinue any App or product within the AI Duo Pics ecosystem (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

14. Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or in-app notification for material changes
• Provide you an opportunity to review the changes before they take effect

Your continued use of the Apps after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Apps and delete your account.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or technical failures.
